[EXCERPT] . . . .

Fetuses are of course fundamentally valuable, but in such a manner to possess rights. (Patrick, 2010)

(iv) The moral status of fetus:

Another important issue governing the illegality of abortion is the moral status of the fetus. If we examine what kind of moral status the developing fetus has, we find that it has different status in various stages of its development and to weigh it value or rights let us examine an initial approach and name it method 1 and make a distinction from a broader approach i.e. method 2. In method 1, we concentrate on the characteristic of the fetus and whether it is a person or possesses a new moral status from that point onwards. Method 2 revolves around the issue of a more general question asking us to contemplate regarding what type of beings of any type, either human or otherwise, possesses certain special moral status and also rights like the right to existence. (MacKinnon, 2010)

Under method 1 we concentrate on fetal development and put forth there aspect regarding possibly important stages like (a) what is present (b) when is this present implying at what stage and (c) why is this important. To put it differently, it will examine, why does this being given special moral status. If at all, it does, special moral status implies several entities. And the most vital would be if the status were such that the fetus would be perceived to possess like a right to life. Under method 1, the late term fetus has much right as any other person. Even though some person might take a stance on the evolving value position as a logical and moral, it would be more intricate to apply the same in a legal perspective wherein claims and intere

sts would require to be openly evaluated and compared. Under method 2, fetus is considered as a human as it is not a part of the pregnant women, rather a separate being. Abortion is morally inhuman as the loss of an early form of human life is truly loss of a portion of the mother's own life. (MacKinnon, 2010)

Conclusion:

Despite the divided opinion about granting legal sanction in favor of abortion, abortion should not be legalized as it kills an unborn baby. From the above paragraphs the pro-life position stance emerges as the most reasonable one and therefore abortion in its every form should be made illegal such that we are able to safeguard the child's right to live. Killing pre-born babies is akin to killing born babies under the concept of natural justice. According to the pro-life theory every child should to be medically safeguarded and there should not be any exceptions to this. Hence abortion should not be given legal sanction as it does more harm than good.
