The department endeavors to attract and retain these high-quality and high-performing employees to carry out the department's objectives. Part of its offering is to develop and train these special employees' technical and managerial skills through appropriate programs. The Department also provides pay bands according to the nature of, and expectations from, these career positions as well as salary increases, based on their performance. These employees must pass the probationary status and achieve permanent status after one year of satisfactory performance. If dismissed during the probationary period, they cannot appeal their case (The Florida Legislature).Excluded career service employees shall be paid their regular rate for contracted hours every two weeks (The Florida Legislature, 2015; DCF, 2014). Their pay will include holidays and leave with pay and Regular Compensatory Leave credits on an hour-for-hour basis. Regular leave credits will be computed on an hour-for-hour basis for approved and performed work hours beyond the 80 hours in a 14-day time frame. Regular compensatory leave credits are payable up to a maximum of 240 hours (The Florida Legislature, DCF).
What the agency should do in the future to comply?
The agency should make sure that it follows the provisions of the Code to the letter in order to comply. It should be careful in selecting excluded career service employees for their qualifications (The Florida Legislature, 2015; DCF, 2014). The employees should be screened well through their one-year probation period. A Career Grievance process may be resorted to in order to address any dissatisfaction (The Florida Legislature). A career service employee has achieved a permanent status may appeal his or her dissatisfaction. Such as employee may not be dismissed except for cause (The Florida Legislature).
Conclusion
Employees are universally paid extra compensation for extra work hours actually performed and previously approved. |Excluded career service employees are, however, are hired and screened to perform high-level tasks in the interest of public service. They are provided special technical and managerial training for the tasks. Their compensations are different from regular or included employees as they perform special tasks. The department directors in this agency cannot seek additional monetary compensation for extra work hours like regular employees as clearly explained by the Florida Administrative Code.
