5).Given the flexibility of New Zealand's Constitution, several of what compounds its regularities is a recurrent topic. However, in 2005 it was acknowledged that ?few if any of the issues required urgent attention. Many of them are important questions, but that is not the same as there being an urgent problem. (Dunne, 2005, p. 16) Since then, the position seems to have maintained and no drastic changes have been brought about. New Zealand maintains its important feature of a representative democracy. Furthermore, it remains faithful in being represented by a responsible government. Meanwhile, the Tribunal continues to assess issues of breaches in the Treaty of Waitangi but no formal measure has been yet addressed as to incorporate it formally as part of the Constitution. As already stated, such a measure would call for an increased proactive attitude, more than what has already been considered. We maintain our position that the Treaty of Waitangi might have the power to transform certain basic points in the Constitution of New Zealand. However, this would happen in full consideration of what the Treaty is about and what it addresses. Furthermore, an approach to validate its relevance in modern New Zealand is further required.
